    Birdiebee Ambassadors earn a standard commission rate of 10% issued as store credit, or 5% via PayPal.

    We reserve the right to reverse or adjust commissions due to:

    • Returned, canceled, or duplicated orders

    • Disputed transactions

    • Orders that cannot be fulfilled or are deemed personal in nature

    Commissions may also be deferred or refused for invalid, fraudulent, or ineligible orders at our discretion.

    LEGAL COMPLIANCE

    BIRDIEBEE AMBASSADOR PROGRAM TERMS + CONDITIONS

    CONTENT SUBMISSION, CONDUCT & COMMUNITY STANDARDS

    By submitting, uploading, tagging, or otherwise sharing any content in connection with Birdiebee or the Birdiebee Ambassador Program, you grant Birdiebee Worldwide, LLC dba Birdiebee (“Birdiebee”) your express, informed, and irrevocable consent to use such content—including your name, likeness, and handle—for commercial, promotional, or marketing purposes in any media, worldwide, without further notice, approval, or compensation.

    You represent and warrant that any and all content posted, shared, or submitted by you in connection with Birdiebee is your own original work, and that you hold all necessary rights—including music, sound, and visual elements—to grant Birdiebee this usage permission. All content must comply with applicable copyright, trademark, and intellectual property laws.

    Birdiebee is committed to maintaining an inclusive, supportive, and respectful community. Accordingly, any form of bullying, harassment, intimidation, or public disparagement—whether directed at other ambassadors, Birdiebee team members, or members of the public—will not be tolerated. This includes (but is not limited to) negative, defamatory, or harassing comments on photos, posts, or accounts associated with the Birdiebee brand or its ambassadors.

    Any negative, disparaging, defamatory, or bullying behavior on social media or other public platforms—whether about Birdiebee, its owners, employees, ambassadors, or affiliates—constitutes a material breach of this Agreement and will result in immediate removal from the Program and forfeiture of any unpaid commissions.

    Birdiebee further reserves the right to remove or restrict access to comments, posts, or content that violate these standards, and to suspend or permanently ban participants engaging in such conduct.

    AFFILIATE AGREEMENT

    This Affiliate Agreement (the “Agreement”) sets forth the complete terms and conditions between Birdiebee Worldwide, LLC dba Birdiebee (“we,” “us,” or “Birdiebee”) and you (“Affiliate”), governing your application to and participation in the Birdiebee Ambassador Program (the “Program”).

    By joining or participating in the Program, you agree to establish promotional links from your social media accounts (“Affiliate’s Social Platforms”) to www.birdiebee.com (the “Birdiebee Site”) in exchange for potential commissions.

    BY SUBMITTING AN APPLICATION TO JOIN OR BY PARTICIPATING IN THE PROGRAM, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT, AS WELL AS ALL MATERIALS AND POLICIES SUPPLIED BY BIRDIEBEE.

    We reserve the right to update or modify this Agreement at any time. It is your responsibility to periodically review the Program Terms for changes.

    1. ELIGIBILITY

    To participate, you must be a legal resident of the United States and at least 18 years of age (or the age of majority in your state). Employees, agents, or representatives of Birdiebee or its affiliates are not eligible to participate.

    2. DEFINITIONS
    • Affiliate – The individual participating in the Program through promotional activity on approved social media platforms using a unique tracking link.

    • Commission Fee – The amount payable to Affiliate for each Qualified Purchase.

    • Link – A unique tracking URL provided by Birdiebee.

    • Post – Any content (post, story, video, blog, etc.) created by Affiliate showcasing a Birdiebee product in compliance with these Terms.

    • Product – Any item available for sale on the Birdiebee Site.

    • Qualified Purchase – A valid sale of Product(s) to a Referred Customer through Affiliate’s Link, excluding self-purchases, fraudulent orders, or discounted orders exceeding 25% off.

    • Referred Customer – A new customer referred to the Birdiebee Site via Affiliate’s Link who completes a Qualified Purchase.

    3. ENROLLMENT & ACCEPTANCE

    Submitting an application does not guarantee acceptance. Birdiebee reserves the right to accept, reject, suspend, or terminate participation at any time, with or without cause. Affiliates must notify Birdiebee within five (5) days of any major change to their social media presence or content that could impact Program suitability.

    4. LINKS & CONTENT STANDARDS

    Affiliates may not modify Birdiebee-provided Links or creative materials. Birdiebee is not responsible for tracking errors caused by improper formatting, link tampering, or technical issues on Affiliate’s end.

    All content posted under this Program must:

    • Accurately represent Affiliate’s genuine opinions and experiences;

    • Tag and mention @mybirdiebee and include the hashtag #BirdiebeePartner clearly and conspicuously;

    • Avoid references to competing brands;

    • Comply with FTC Endorsement Guidelines and all applicable platform policies;

    • Avoid defamatory, misleading, obscene, infringing, or inappropriate content;

    • Depict only Affiliate or individuals over 18 years of age who have granted written consent.

    Noncompliance may result in suspension, withheld commissions, or termination.

    5. ORDER PROCESSING & COMMISSIONS

    Birdiebee will process all orders placed by Referred Customers and reserves the right to reject any order that fails to meet Program requirements.

    Affiliates earn commissions as follows:

    • 10% of Qualified Purchases if paid in store credit, or

    • 5% of Qualified Purchases if paid via PayPal.

    Commissions are not earned on:

    • Self-purchases or personal-use orders;

    • Orders discounted 25% or more (unless approved in writing);

    • Cancelled, returned, fraudulent, or unfulfilled orders;

    • Orders placed prior to Program enrollment.

    6. PAYMENT TERMS

    Commissions will be paid within 60 days of the related order date, subject to verification. Payments are made via PayPal or store credit, depending on the selection in your application. Birdiebee may adjust payment methods or schedules with prior notice.

    7. RIGHTS & LICENSES

    Affiliates are granted a limited, revocable, non-transferable license to use Birdiebee’s trademarks, logos, and provided materials solely for Program participation and during its active term. All Birdiebee intellectual property remains the sole property of Birdiebee.

    8. USE OF AFFILIATE CONTENT

    Affiliate retains ownership of their Posts but grants Birdiebee a perpetual, worldwide, royalty-free license to use, reproduce, distribute, display, and adapt such Posts—including Affiliate’s name, image, likeness, and handle—in any medium, for any lawful purpose, without further approval or compensation.

    9. INDEPENDENT CONTRACTOR STATUS

    Participation in the Program does not create any employment, partnership, or agency relationship. Affiliates act as independent contractors and have no authority to bind Birdiebee in any contract.

    10. LIMITATION OF LIABILITY

    To the fullest extent permitted by law, Birdiebee shall not be liable for any indirect, incidental, special, or consequential damages arising from this Agreement. Birdiebee’s total cumulative liability shall not exceed the total commissions paid to Affiliate during the preceding three (3) months.

    11. INDEMNIFICATION

    Affiliate agrees to defend, indemnify, and hold harmless Birdiebee, its officers, directors, employees, and agents from any claims, damages, or expenses arising out of Affiliate’s breach, misconduct, or violation of this Agreement.

    12. TERMINATION

    Either party may terminate participation at any time, with or without cause, via written notice. Upon termination, Affiliate must immediately remove all Links, tags, and promotional materials. Sections 8, 10–13, and 15–17 shall survive termination.

    13. MODIFICATION OF TERMS

    Birdiebee reserves the right to modify, update, or replace these Terms and Conditions at any time, without prior notice, in its sole discretion. Any such modifications will be effective immediately upon posting of the updated Terms on the official Birdiebee website at www.birdiebee.com.

    It is your responsibility to review these Terms periodically. Your continued participation in the Birdiebee Ambassador Program after any changes are posted constitutes your binding acceptance of the revised Terms and Conditions.

    14. GOVERNING LAW & ARBITRATION

    This Agreement shall be governed by the laws of the State of New York. All disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA) in New York, NY. Affiliate waives any right to participate in class actions or seek injunctive relief.

    15. CONFIDENTIALITY

    Affiliate agrees to maintain the confidentiality of all nonpublic information disclosed by Birdiebee, including pricing, sales data, or program structure.

    16. PHOTO RELEASE

    By participating, you grant Birdiebee an irrevocable license to use your likeness in photos or videos in connection with Birdiebee’s marketing, advertising, or promotions, without compensation. You waive any right to inspect or approve final materials and release Birdiebee from all related claims.

    17. ENTIRE AGREEMENT

    This document constitutes the entire agreement between you and Birdiebee regarding the Ambassador Program and supersedes all prior agreements, discussions, or understandings, whether written or oral.
